These guidelines are for Westwood Shipping Lines licensees, authorized resellers, developers, customers, and other parties wishing to use Westwood Shipping Lines trademarks, service marks, or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging. Use of Westwood Shipping Lines trademarks may be prohibited, unless expressly authorized.

If you are a licensee of a Westwood Shipping Lines trademark or logo and have been provided with special trademark usage guidelines with your license agreement, please follow those guidelines. If your license agreement does not provide usage guidelines, then follow these guidelines.

Westwood Shipping Lines trademarks, service marks, trade names, and trade dress are important assets. In following these guidelines, you help us protect our valuable trademark rights and strengthen our corporate and brand identities. By using an Westwood Shipping Lines trademark, in whole or in part, you are acknowledging that Westwood Shipping Lines is the sole owner of the trademark and promising that you will not interfere with Westwood Shipping Lines rights in the trademark, including challenging Westwood Shipping Lines use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any Westwood Shipping Lines trademark. The goodwill derived from using any part of a Westwood Shipping Lines trademark exclusively inures to the benefit of and belongs to Westwood Shipping Lines. Except for the limited right to use as expressly permitted under these Guidelines, no other rights of any kind are granted hereunder, by implication or otherwise. RULES FOR PROPER USE OF WESTWOOD SHIPPING LINES TRADEMARKS

Trademarks are adjectives used to modify nouns; the noun is the generic name of a product or service. As adjectives, trademarks may not be used in the plural or possessive form. Do not use a trademark as a verb. An appropriate generic term must appear after the trademark the first time it appears in a printed piece and as often as is reasonable after that.

Always spell and capitalize Westwood Shipping Lines trademarks exactly as they are shown in Westwood Shipping Lines web pages. Do not shorten or abbreviate Westwood Shipping Lines product names. Do not make up names that contain Westwood Shipping Lines trademarks.

When making fair use of a Westwood Shipping Lines trademark, you must mark and attribute them as outlined in these guidelines.

Westwood Shipping Lines trade dress may not be used by third parties for their own products or web sites. Please ensure that your product line, packaging, advertising or web site does not adopt a look that is confusingly similar to any of Westwood Shipping Lines.


AUTHORIZED USE OF WESTWOOD SHIPPING LINES TRADEMARKS


ADVERTISING, PROMOTIONAL, AND SALES MATERIALS

Only Westwood Shipping Lines and its authorized resellers and licensees may use the Westwood Shipping Lines Logo in advertising, promotional, and sales materials. Westwood Shipping Lines Authorized Resellers may use the Westwood Shipping Lines Logo only as specified in their reseller agreement.


COMPATIBILITY

Developers may use Westwood Shipping Lines, or any other Westwood Shipping Lines word mark (but not the Westwood Shipping Lines Logo or other Westwood Shipping Lines-owned graphic symbol/logo) in a referential phrase on packaging or promotional/advertising materials to describe that the third party product is compatible with the referenced Westwood Shipping Lines product or technology, provided they comply with the following requirements:

  • The Westwood Shipping Lines word mark is not part of the product name.
  • The Westwood Shipping Lines word mark is used in a referential phrase such as "for use with," "for," or "compatible with."
  • The Westwood Shipping Lines word mark appears less prominent than the product name.
  • The product is in fact compatible with, or otherwise works with, the referenced Westwood Shipping Lines product.
  • The reference to Westwood Shipping Lines does not create a sense of endorsement, sponsorship, or false association with Westwood Shipping Lines or Westwood Shipping Lines products or services.
  • The use does not show Westwood Shipping Lines or its products in a false or derogatory light.

PUBLICATIONS, SEMINARS, AND CONFERENCES

You may use a Westwood Shipping Lines word mark in connection with book titles, magazines, periodicals, seminars, or conferences provided you comply with the following requirements:

  • The use reflects favorably on both Westwood Shipping Lines and Westwood Shipping Lines products or technology.
  • Your name and logo appear more prominent than the Westwood Shipping Lines word mark on all printed materials related to the publication, seminar or conference.
  • The Westwood Shipping Lines logo or any other Westwood Shipping Lines-owned graphic symbol, logo, icon or image does not appear on or in the publication or on any materials related to the publication, seminar, or conference without express written permission from Westwood Shipping Lines.
  • A disclaimer of sponsorship, affiliation, or endorsement by Westwood Shipping Lines, similar to the following, is included on the publication and on all related printed materials: "(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by Westwood Shipping Lines."
  • A trademark attribution notice is included in the credit section giving notice of Westwood Shipping Lines ownership of its trademark(s). Please refer to the section below titled "Proper Trademark Notice and Attribution."

LINKS

You may place a link to a Westwood Shipping Lines web page on your site if the text link is not a prominent feature on the site or used in a way to mislead or confuse consumers. You may refer to the Westwood Shipping Lines name or product or service names in a plain text font and format provided the use follows Westwood Shipping Lines trademark guidelines and you include appropriate wording such as "link to wsl.com".


UNAUTHORIZED USE OF WESTWOOD SHIPPING LINES TRADEMARKS


COMPANY, PRODUCT, OR SERVICE NAME

You may not use or register, in whole or in part, Westwood Shipping Lines, or any other Westwood Shipping Lines trademark, including Westwood Shipping Lines-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines or pursuant to an express written license from Westwood Shipping Lines.


WESTWOOD SHIPPING LINES LOGO AND WESTWOOD SHIPPING LINES-OWNED GRAPHIC SYMBOLS

You may not use the Westwood Shipping Lines Logo or any other Westwood Shipping Lines-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from Westwood Shipping Lines, such as a reseller agreement. You may request permission to use the Westwood Shipping Lines Logo or any other Westwood Shipping Lines-owned logo by contacting us and submitting an e-mail under the category "Logo Usage".


VARIATIONS, TAKEOFFS OR ABBREVIATIONS

You may not use an image of a real Westwood Shipping Lines or other variation of the Westwood Shipping Lines logo for any purpose. Third parties cannot use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of a Westwood Shipping Lines trademark for any purpose.


SLOGANS AND TAGLINES

You may not use or imitate a Westwood Shipping Lines slogan or tagline.


WESTWOOD SHIPPING LINES TRADE DRESS AND ADVERTISING ELEMENTS

Westwood Shipping Lines trade dress may not be used by third parties for their own products or websites. Please ensure that your product line, packaging, advertising or web site does not adopt a look that is confusingly similar to any of Westwood Shipping Lines. All page headers, custom graphics, button icons, and scripts are trademarks and/or trade dress of Westwood Shipping Lines and may not be copied, imitated, or used in whole or in part, without the prior written permission of Westwood Shipping Lines.


ENDORSEMENT OR SPONSORSHIP

Westwood Shipping Lines does not support the use of its logos, company names, product names, or images of Westwood Shipping Lines products by other parties in marketing, promotional or advertising materials as their use may create the perception that Westwood Shipping Lines endorses or sponsors the product, service or promotion.


DOMAIN NAMES

You may not use any Westwood Shipping Lines trademark or virtually identical trademark in the title of your web site, as a second-level domain name, or subdomain.

Not acceptable:

  • "Yourname.WestwoodShippingLines.com"
  • "www.wsl.com"
  • "Yourname@WSL.com"


MERCHANDISE ITEMS

You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing Westwood Shipping Lines, iLevel, or any other Westwood Shipping Lines trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from Westwood Shipping Lines.


DISPARAGING MANNER

You may not use a Westwood Shipping Lines trademark or any other Westwood Shipping Lines-owned graphic symbol, logo, or icon in a disparaging manner.


PROPER WESTWOOD SHIPPING LINES TRADEMARK NOTICE AND ATTRIBUTION

All Westwood Shipping Lines trademarks must be property attributed. Trademark ownership is attributed in two ways:

  • With the use of a trademark symbol (TM, SM, ®) after the trademark.
  • With a trademark legend, usually placed at the end of a document in fine print directly after the copyright notice

TRADEMARK SYMBOLS

The appropriate trademark symbol must be used when making reference to any Westwood Shipping Lines trademarks. For more information, please contact support@wsl.com

Wherever possible, the symbol should be placed directly after the trademark in a superscript and in a size smaller than the mark itself. If you are unable to use the symbols due to the software you are using, you should use parenthetical versions as follows: (R), (tm), or (sm).

The trademark symbol does not need to be included in every use of the trademark. The trademark symbol must always be used:

  • Upon the first use of the Westwood Shipping Lines trademark appears the text of the advertisement, brochure, or other material; and
  • For all prominent uses of the trademark including title pages or headings.

TRADEMARK LEGENDS

Westwood Shipping Lines trademarks and products must be properly identified as originating from Westwood Shipping Lines by including a brief statement (legend) attributing ownership of these trademarks to Westwood Shipping Lines within the credit notice section of your product, product documentation, or other product communication. The following legend should be used on all materials that reference Westwood Shipping Lines trademarks:

Westwood Shipping Lines, [list Westwood Shipping Lines trademarks/products referenced in the materials], are trademarks or registered trademarks of Westwood Shipping Lines Company or its subsidiaries in the U.S. and other countries.

The trademark legend must be clear in order to avoid any confusion over who is the owner of each mark. Following are the correct formats:

Westwood Shipping Lines is a registered trademarks of Westwood Shipping Lines.

Westwood Shipping Lines trademarks should be specifically credited and not referred to generically as "...all other trademarks are owned by their respective companies" or similar language.

Do not use or add any other statements to the legend that in any way suggest that you have or are claiming any rights in a Westwood Shipping Lines trademark.


NO CHALLENGES

You agree that you will not challenge, encourage, assist, or otherwise induce third parties to challenge the Westwood Shipping Lines marks (except to the extent such restriction is prohibited by law) or our registration thereof, nor shall you attempt to register any trademarks, service marks, trade names, logos, product names, service names, legends, domain names, other designations, or abbreviations of any of the foregoing, or other distinctive brand features that are confusingly similar in any way (including, but not limited to, appearance and spelling)to the Westwood Shipping Lines marks.


WARRANTY

USE OF ANY WESTWOOD SHIPPING LINES TRADEMARK IS AT YOUR OWN RISK. THE USES PERMITTED HEREUNDER ARE PROVIDED BY WESTWOOD SHIPPING LINES “AS IS”, WITHOUT ANY WARRANTIES WHATSOEVER, INCLUDING (WITHOUT LIMITATION) ANY WARRANTY OF NON-INFRINGEMENT. YOU AGREE TO INDEMNIFY AND DEFEND WESTWOOD SHIPPING LINES AND HOLD WESTWOOD SHIPPING LINES, ITS SUCCESSORS AND ASSIGNS, HARMLESS OF AND FROM ANY CLAIM, ACTION, SUIT, LOSS, COST, EXPENSE OR OTHER DAMAGES OR LIABILITY WHATSOEVER (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS’ FEES) ARISING OUT OF OR RESULTING FROM YOUR USE OF ANY WESTWOOD SHIPPING LINES TRADEMARKS IN VIOLATION OF THE WESTWOOD SHIPPING LINES TRADEMARK AND LOGO USAGE REQUIREMENTS.


USE OF WESTWOOD SHIPPING LINES COPYRIGHTED CONTENT AND MATERIALS

Westwood Shipping Lines products, services, marketing materials, and Web content, including images and text, are owned by Westwood Shipping Lines and/or by Westwood Shipping Lines vendors, who have given Westwood Shipping Lines permission to use the material. Only Westwood Shipping Lines and its authorized resellers and licensees may use Westwood Shipping Lines images and text in advertising, promotional, and sales materials.
